Welcome to Changemaker Library!

The Terms of Use governs your use of the services (“Services”) and the Changemaker Library website and application (“Site”) of Ashoka Korea (“we” or “us”). We make the Terms of Use available on the Site so that you may easily access it. Please read it carefully.

THE TERMS OF USE INCLUDES A RELEASE BY YOU OF ALL CLAIMS FOR DAMAGES AGAINST US THAT MAY ARISE OUT OF YOUR USE OF THE SITE TO THE EXTENT ALLOWABLE UNDER APPLICABLE LAWS AND REGULATIONS. BY USING THE SITE, YOU ARE AGREEING TO THIS RELEASE EXCEPT AS OTHERWISE REQUIRED BY APPLICABLE LAWS AND REGULATIONS.

Services
We offer the following Services through the Site:
introduction to Ashoka and Changemaker Library;
provision of the information of Ashoka Fellows and sharing of any digital content (signs, letters, voice recordings, sounds, images, and videos that a user has uploaded on the Site or via external links) (“Content”) and other related information related to Ashoka Fellows;
introduction and promotion of events related to our Services; and
provision of other various information related to Ashoka and our Services.
We may, if necessary, change the details of our Services.
Registration and Your Information
You have to register an account to access and use the Site. In order to register, you will need to fill out your information in the form prescribed by us online and check the box that you consent to the Terms of Use. Upon our approval thereof, a service use agreement between you (“Member”) and us will be executed. You may use only one email address in your name to register an account and you may not register more than one account. The email address that you use for registration should not be changed, and if you wish to change the email address due to inevitable circumstances, you should contact us(contact@changema.kr). You are responsible for maintaining the confidentiality and security of your account credentials and may not disclose your credentials to any third party. You will be liable for any damages caused by your negligence or illegal use thereof. You are responsible and liable for activities conducted through your account and must immediately notify us if you suspect that your credentials have been lost, stolen, or your account is otherwise compromised.

If we suspect that your registration or profile information are inaccurate or incomplete, we may suspend or terminate your account, to the extent allowable under applicable laws and regulations. We reserve the right, to the extent allowable under applicable laws and regulations, to remove or reclaim it if we believe appropriate in case of, including but not limited to, the following:
you select a username for your account, and there is a trademark infringement claim against it;
the email address is not valid;
there are any misstatements, omissions, and falsifications;
you use a third party information or name to register an account;
you are not eligible for registration, or your account had been suspended or terminated by us in the past for reasons stipulated in the Terms of Use;
you are likely to cause harm to us, other services provided by us, and other users of our Services; or
our Service capacity is insufficient or there is a technical error on our end.
If we disable your account, you may not be able to create another username without our permission.

Your account with us is valid only on the Site. In order to use other websites that we operate, you should register an account with that particular website and the terms of use and privacy policy of such website shall apply.
Privacy Policy
Please refer to our Privacy Policy for information on how we collect, use and disclose information from our users. You acknowledge and agree that your use of our Services is subject to our Privacy Policy.
Our Obligations
We will use best efforts to continue to provide our Services in a professional manner in accordance with the Terms of Use. We will maintain and repair our Services and the information communication equipment necessary to perform the Services to ensure that you are provided adequate Services at all times, and if there is any failure therein, we will make best efforts to repair and restore them without any delay. We have a security system to protect your personal information to ensure your safe use of our Services. We will not send any marketing emails for any profit-seeking purposes that you expressly do not wish to receive.
Your Obligations
You should use our Services in compliance with applicable laws and regulations, and the Terms of Use. You should not engage in any profit-seeking activities by using the Site or our Services without our prior written approval.

If your personal information that you provided us for registration of an account has changed, you should immediately make the necessary change on the Site. You will be liable for any damages caused by your failure to make the change unless it is delayed for reasons not attributable to you.
Your Conduct and Content
When our users stand behind their opinions and actions, our Platform is safer and more accountable.
For this reason, you must:

- not impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity;

- not share your password or give access to your Changemaker Library account to others; and

- not assign or transfer your account, an authority to use the Site and any other contractual status granted thereunder to a third party, or provide it as collateral to a third party.

You should not use the Site to do or share anything that is unlawful, objectionable, threatening, abusive, harmful to minors (including any form of child pornography or indecent depictions of children), harassing, tortuous, vulgar, invasive of another’s privacy, hateful or racially, ethnically or otherwise objectionable, misleading, discriminatory or fraudulent.
You should not use the Site to do or share anything that infringes or violates someone else's rights, including their intellectual property rights (patent, trademark, trade secret, copyright or other contractual or proprietary right).
You should not use the Site to do or share anything that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements, any private information of any third party, any content you did not create or you did not have permission to post). You should not upload any viruses or malicious code, files or programs or do anything that could disable, destroy, overburden, or impair the proper working or reputation of the Site.
You should not access or collect data from the Site using automated means (without our prior permission) or attempt to access data you do not have permission to access.
You should not obtain any information or Content from the Site using any robot, spider, scraper or other automated means for any purpose.
You should not take any action that imposes or may impose, as determined in our sole discretion, an unreasonable or disproportionately large load on our IT infrastructure.
You should not upload any Content other than those of a personal nature.
You should not collect or store personal information, including email addresses or data about other users in connection with the prohibited activities described in this paragraph.
You should not attempt to gain unauthorized access to, or circumvent or attempt to circumvent any security or access control technology implemented in, the Site or the servers and network associated with the Site.
You should not use the Site or any email in any Ashoka Korea’s domain to deliver unsolicited bulk email.
You should not publicize or offer any contest, giveaway, or sweepstakes on the Site without following all applicable laws and regulations.
You should not intentionally or unintentionally violate any applicable local, state, national or international laws and regulations.
You should not use the information obtained from the Site (including but not limited to the Contents posted on the Site) by means of copying, reproducing, changing, translating, publishing, broadcasting, or otherwise exploiting without our prior written approval. You should not provide such information to a third party or make a derivative thereof without our prior written approval.
You should not post any Content for profit-seeking, commercial, marketing or promotional purposes without our prior written approval.
You may, at any time, take measures (such as deleting or modifying) to the Contents that you post on the Site via our Customer Service Center or the “Setting” feature in our Service.
You should not use any contents copyrighted by us on the Site for profit-seeking purposes by means of modification, reproduction, editing, transmission, publication, distribution, broadcasting, or otherwise exploiting without our prior written approval. You should not provide such content to a third party without our prior written approval.
You acknowledge that we may modify, reproduce or edit anything you post on the Site in part or in whole to the extent necessary for purposes of marketing and promotion of Ashoka Korea and the provision of our Services; provided that we will obtain your prior consent.
You acknowledge that anything you post on the Site may be exposed in search results of the Site as well as those of other search engines.
You should not post any Content which slanders or insults others.
You agree that we may or may not pre-screen Content, but that we have the right (not the obligation) in our sole discretion, to pre-screen, refuse, remove or move any Content that is available via the Site. Without limiting the foregoing, we will have the right to remove any Content that violates the Terms of Use or we are required to do so by law. You should assess and bear all risks associated with your use of any Content, including any reliance on the details, integrity and accuracy thereof.
Content Copyright
Ownership of copyrights to the Contents provided through the Site follows applicable laws and regulations. In general, all copyrights of Contents provided through the Site belong to the copyright owner of certain Content. No third party may use, modify or transform the Content for commercial purposes without the prior consent of the copyright owner.

If you are a copyright owner and have a good faith belief that a Content available through the Site infringes upon your copyrights, you may submit a copyright infringement claim to us (contact@changema.kr) with the following information in writing:
an electronic or physical signature of the copyright owner or the person authorized to act on behalf of the copyright owner;
a description of the copyrighted work that you claim has been infringed;
a description of where the potentially infringing content is located on the Site, with enough details to allow us to locate it on the Site;
your address, telephone number, and email address;
your own statement that you have a good faith belief that the disputed use is not authorized by you or your agent, or the law; and
your a statement made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.
Please consult your legal counsel for further details. We will take necessary measures under applicable laws and regulations in response to your request.
Content Removal and Disabling or Terminating Your Account
We can remove any content or information you share on the Site if we believe that it violates the Terms of Use or we are required to do so by law. We can refuse to provide or stop providing all or part of the Site to you (including terminating or disabling your account) immediately to protect our community or Services if:
you create a risk or legal exposure to us, the Site or our Services (including but not limited to, by interfering with other’s use of Services or illegally using other’s information);
you violate the Terms of Use or our policies;
you repeatedly infringe a third party intellectual property rights;
we are permitted or required to do so by law;
you provided false information upon registration of an account; or
you use our Services to engage in any activities prohibited by applicable laws and regulations, and the Terms of Use, or against the public order or good morals.
And we can take action to disable or terminate your account. Unless otherwise required by applicable laws and regulations or it is necessary to immediately take above-referenced measures, we will provide you with a prior notice stating the grounds and details of the measures we are taking, and if you disagree with us, you may file a complaint against us. If we find your complaint to be reasonable, we will remove the measures that we have taken.
Cancelling Your Account
You may at any time proceed to cancel your account through the “Cancel your account” feature under the “Setting” in your profile, and we will process it.
Suspension of Services
We may temporarily suspend or restrict our Services when we take measures to maintain, repair or replace our information communication equipment such as computers. We will give you a prior notice of any suspension or restriction of the Services unless it is an emergency. We will not indemnify you or a third party from any damages caused by temporary suspension or restriction of the provision of our Services unless it was caused by our willful misconduct or gross negligence
Links to Other Websites
The Site may contain links to other websites not operated or controlled by us (“Third Party Sites”), including social media websites and services. The information that you share with Third Party Sites will be governed by the specific terms of use of such Third Party Sites and not by the Terms of Use. By providing these links we do not imply that we endorse or have reviewed these sites unless otherwise specified by applicable laws and regulations. Please contact those sites directly for information on their terms of use.
Limits on Liability
We work hard to provide the best Site we can and to specify clear guidelines for everyone who uses the Site. THE SITE, HOWEVER, IS PROVIDED “AS IS,” AND WE MAKE NO GUARANTEES THAT IT WILL ALWAYS BE SAFE, SECURE, OR ERROR-FREE, OR THAT IT WILL FUNCTION WITHOUT DISRUPTIONS, DELAYS, OR IMPERFECTIONS. TO THE EXTENT PERMITTED BY LAW, WE ALSO DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT CONTROL OR DIRECT WHAT ANY OF OUR USERS OR THIRD PARTY DOES OR SAYS, AND WE ARE NOT RESPONSIBLE FOR THEIR ACTIONS OR CONDUCT (WHETHER ONLINE OR OFFLINE) OR ANY CONTENT THEY SHARE (INCLUDING OFFENSIVE, INAPPROPRIATE, OBSCENE, UNLAWFUL, AND OTHER OBJECTIONABLE CONTENT).

We make no warranties or representations of any kind whatsoever about the accuracy or completeness of the Contents of the Site or the contents of any external links and assume no liability or responsibility for:
any errors, mistakes, inaccuracies or omissions therein;
any personal injury or property damage of any kind or nature whatsoever, resulting from your access to and use thereof;
any unauthorized access to or use thereof;
any and all personal information and financial information stored therein;
any interruption or cessation of transmission thereto;
any bugs, viruses, errors, trojan horses or the like that may be transmitted to or by any third party; and
any loss or damage of any kind incurred as a result of use of any contents posted, emailed, transmitted or otherwise made available on the Site or external links.
Any contents downloaded or otherwise obtained through the Site and external links are accessed at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such contents. No advice or information, whether oral or written, that we obtain from you, or through or from the Site and external links will create any warranty not expressly stated in the Terms of Use.

You should be responsible for your use of our Services and be fully liable for all damages and disadvantages incurred by a third party with respect to the materials posted or transmitted by your use of our Services. We will not be liable for such damages and disadvantages unless we are required by applicable laws and regulations.

We will not be liable to any damages that you incur with respect to our free Services unless such damages are caused by our willful misconduct or gross negligence.

Notwithstanding the foregoing, applicable laws and regulations may not allow the limitation or exclusion of liability set forth above. In such case, we shall bear liability to the extent required by such law.

If we become liable for any damages incurred by a third party due to your violation of the Terms of Use, you will have to compensate us for, and indemnify us from, all the damages incurred by us unless it is caused by our willful misconduct or gross negligence.
Changes and Updates
We may modify the Terms of Use to reflect changes to our Services or for legal, regulatory or security reasons. We will provide a reasonable notice of any material modifications to the Terms of Use via email. Modifications to this Agreement will only apply going forward. If you do not agree to the modified terms, you should remove any Content you have uploaded and discontinue your use of the Services.

Any changes to the Terms of Use shall be made publicly available and notified to each user at least seven (7) calendar days before the effective date thereof by means specified below; provided that any changes which are not favorable or material to you shall be made publicly available and notified to each user at least one (1) month before the effective date thereof.

We will clearly notify the Members of any changes and our intent that a Member will be deemed to have agreed to such changes if he/she fails to express his/her disagreement. If a Member does not expressly disagree to such changes by the effective date thereof, the Member will be deemed to have given consent.

Users have the right not to agree to the changes to the Terms of Use, and a Member who does not agree with such changes may cancel his/her account.
Notice
To Members: We will send a notice to the email address indicated in the Member’s account.

To any other users: We will make an announcement on our bulletin board or in a pop-up window on the Site for at least one (1) week; provided that any information which have a material effect on the rights and obligations of, and use of Services by, the Members shall also be notified to each Member.
Governing Law
The Terms of Use and any action related thereto will be governed by the laws of the Republic of Korea. Any disputes that arise from use of the Services or between our users and Ashoka Korea in connection with the Services shall be governed by the Korean Civil Procedure Act and other applicable laws.
Relevant Statutes
Unless otherwise specified, the Terms of Use will be governed by the following Korean statutes, including but not limited to: the Act on the Regulation of Terms and Conditions; the Framework Act on Electronic Documents and Transactions; the Electronic Financial Transactions Act; the Digital Signature Act; the Act On Promotion of Information and Communications Network Utilization and Information Protection; and the Personal Information Protection Act.
